Jay Cutler Allegedly Tried to Flee Scene of DUI Arrest After Offering Other Driver $2K to Not Call Police

New allegations surrounding Jay Cutler’s DUI arrest have surfaced.

The NFL star was charged with a first offense of driving while intoxicated—as well as possession of a handgun while under the influence, failure to exercise due care and a violation of implied consent law—on Oct. 17 in Franklin, Tenn., after a minor traffic collision between two cars, according to authorities.

A police affidavit obtained by E! News Oct. 17 indicates that the driver of the vehicle Jay’s white Ram allegedly rear-ended told responding officers that the 41-year-old attempted to flee the scene after offering him $2,000 to not call law enforcement.

While speaking with Jay, officers noticed that former Chicago Bears quarterback’s speech was “thick-tongued, slurred and mumbled” and his eyes as “bloodshot,” according to the charging document. Jay—who shares kids Camden, 12, Jaxon, 10, and Saylor, 8, with ex-wife Kristin Cavallari—allegedly “had an overwhelming odor of an alcoholic beverage emitting from his person,” but denied consuming any alcohol before admitting he’d had “a little bit.”

While Jay refused a field sobriety test, the affidavit indicated he later had his blood drawn at Williamson Medical Center.

Upon searching the Very Cavallari alum’s car, police found a rifle in the backseat and a loaded handgun in the center console, according to the filing. Jay was released on $5,000 bail, and a hearing in the case was set for Jan. 16, 2025.

E! News has reached out to Jay’s rep but has not heard back.

Recently, Kristin—who was married to Jay from 2013 to 2022—noted that the former couple’s custody arrangement had shifted as she discussed her split from boyfriend Mark Estes.

“When I was dating last fall, I was still doing split custody with my ex and I had every other week off from my kids and that's changed,” Kristin revealed earlier this month on her Let’s Be Honest podcast. “So, I'm really happy and really content having my life right now being about my kids and my work.”

The former Laguna Beach star also previously spoke about how her and Jay’s marital problems affected her health.

“I look back at photos from that time period, and I am like, ‘Holy s--t,’” she said on another episode of Let’s Be Honest. “I was rail f--king thin. I was skin and bones. I looked like s--t. I think I look so much better now. And you guys, that was just stress. That was being in a really unhappy marriage.”
